En este sentido, el presente trabajo tiene por objeto analizar las situaciones en
que el derecho aplicable se muestra adverso o reticente a acudir a dichas
soluciones y graficar un camino de salida o “válvula de escape” ante la rigidez,
para brindar una solución razonable y equitativa a las partes.

Para ello, principalmente recurriremos a los principios generales del derecho —
sobre todo el de buena fe y equidad— como aliados en este proceso para paliar
los efectos residuales de la pandemia.

Abstract- In times of coronavirus, words such as emergency, alarm,
unpredictability, impossibility and impracticability, hardship and frustration of
purpose, among others, are commonplace in legal forums and in the world's
main news. It is an indisputable fact that trial courts and arbitral tribunals will
be flooded with cases about some of these issues.

However, many conflicts can arise in disputes that are submitted to
arbitration/adjudication in virtue of the applicable law that the parties have
decide to choose.

The purpose of this work is to analyze the situations in which the applicable law
is adverse or reluctant to resort to such solutions and to chart an exit route or
“escape valve” in the face of rigidity as well as to provide a reasonable solution
and equitable to the parties.

To do so, we will mainly resort to the general principles of law—especially that
of good faith and equity—as allies in the process to mitigate the residual effects
of the pandemic.
