                        There have always been five devices by which parties engage in

                discovery:  the deposition, interrogatories, requests to produce, medical

                examinations, and requests for admission.  All five can be used to get
                information from a party to the case, but only two-the deposition and the

                request to produce--can be used to obtain information from nonparties.

                        The first discovery tool is the  deposition. Here, the person being

                çdeposedé testifies orally under oath, just as she would if she were a witness

                at trial. But here, her testimony is not given in the courtroom and no judge

                or jury is present. Depositions are taken in somebodyûs office. The deponent
                responds to questions asked by the lawyers for all parties. The questions and

                answers are recorded by a stenographer and usually transcribed into booklet

                fom. The deponent reviews the booklet, corrects any errors, and signs the
                transcript under oath. ...
