Variable Hour Employees – Employees whose hours of work cannot reasonably be
determined to be more than 30 hours per week at the time of hire. Benefits eligibility will
be based on hours worked after a twelve-month measurement period, as described in
the benefits section of this handbook.
FLSA Classifications
In addition to the employee classifications above, all Amy’s Drive Thru employees are
classified as one of the two following categories:
Non-Exempt Employees - Hourly employees who are entitled to be paid at least the
minimum wage per hour and an overtime premium in accordance with state and federal
law.
Exempt Employees – Salaried employees whose work duties exempt them from the
overtime provisions of the applicable state and/or federal wage and hour laws. Exempt
employees are not subject to overtime laws and are not eligible for overtime
compensation.
Employees who have any questions regarding their status should contact their
supervisor or manager.
An employee’s classification may be changed only upon written notification by the
Company. There are no automatic conversions from one classification to another.
Please speak to your supervisor if you have any concerns or questions about your
classification.
ATTENDANCE
The success of Amy’s Drive Thru depends upon the cooperation and commitment of
each member of our team. Therefore, your attendance and punctuality are extremely
important. All employees are expected to work on a regular, consistent basis and
complete their regularly scheduled hours per week. Excessive absenteeism may result
in disciplinary action, up to and including termination. Disciplinary action taken because
of absenteeism will be considered on an individual basis, following a review of the
employee’s absentee and overall work record.
If you are going to be late or miss work, employees are expected to call and talk
to a member of the Leadership Team at least 2 hours before they are scheduled
to work.
Any employee who does not call or report to work for two consecutive shifts will
be considered to have voluntarily resigned employment at Amy’s Drive Thru.
