Case #2:
Deposition - Lead Instructor / Role Player
Key statements:
• There was an inadequate amount of PPE so it was deemed “optional”.
• He is the best shooter in the department and never misses, etc…
• In this training event he only shot at officers “below the waist”.
• This was a dynamic scenario with several participants. Everyone was moving
horizontally, vertically and laterally and largely unpredictable.
Case #2:
Conclusions - Causations
• The primary causation of the officers injuries was deeming PPE as optional.
• Had she been wearing the mandatory full face and head protective helmet the injury would have been
prevented.
• This specific training event could have been shifted from a testing to a teaching scenario and conducted at 1/2
speed using blanks with zero loss of training value.
• The secondary causation was that the role player was shooting faster than he could process the environment.
• My client stated / reported that “the officer is the best in the department and the state would introduce his
qualification scores”.
• My response was “then he shot her in then face intentionally”.
• He asked me: do you really believe that?
• I responded “of course not, but that’s what her council will argue”.
• The case was settled prior to trial
