(5) This Arlielo shall apply to tho construction of any Rogulutions, Rules,
or Orders mado uudor this Ordor, unloss a contrary intontiou appears.
(i. Whoro this Order refers to any specified Act or Acts of Parliament,
such roforcnco shall, unless a contrary intontiou appoars, bo .doomed to includo
any Act or Acts amending or substituted for the same.
7. In tho ovont of tho death, incapacity, removal, or absonco from Bahrein
of tho Political Agent for tho timo being, all and ovory tho powers, authorities,
and immunities by this Ordor granted to him shall, until His Majesty’s further
ploasuro is signified through tho Governor-General of India in Council, bo
vosted in tho Political Resident.
8. Tho powers conferred by this Ordor shall extend to tho persons and
matters following, in so far as by Treaty, grant, usage, sufferance, or othor
lawful moans, His Majesty has jurisdiction in relation to such porsons, matters,
and things, that is to say :—
(1) British subjects, ns heroin dofined, within tho limits of this Order.
(2) Foreigners with respect to whom tho Sheikh of Bahrein has agreed with
His Majesty for, or consontcd to, tho oxorciso of jurisdiction by
Ilis Majesty.
(3) Bahroin subjects registered in tho Political Agency as being in tho
regular sorvico of British subjects or foreigners; with tho proviso
that all eases wheroin such Bahrein subjects arc concerned shall bo
dealt with in accordance with tho provisions of Part V. of this Order.
(4) Tho expression “person to whom this Ordor applies'’ shall bo construed
in accordance with tho abovo threo sub-Articlcs.
(5) Tho property and all personal or proprietary rights and liabilities
within tho said limits of British subjects and of foreigners within
sub-Article (2) and of Bahrein subjects within sub-Articlo (3),
whothor such persons aro thomsclves within or without tho limits
of this Ordor.
((>) British ships and ships bolonging to foreigners within sub-Articlo (2)
with their boats, and tho porsons and property on board thoroof, or
belonging thereto, being within tho limits of this Ordor; provided
that jurisdiction over foreign ships shall not bo. exercised otherwise
than according to tho practico of the High Court in England in tho
oxorciso of jurisdiction ovor foroign ships.
(7) If any question arises whether tho subjects or citi/.ous of any country,
State, or tribo hnvo or havo uot been placed under tho jurisdiction
of Ilis Majesty by agreomont. with, or tho consent of, the Sheikh
of Bahroin, it shall bo referred by the Court to tho Political Rosidcul,
and a certificate under his hand nud seal shall bo couclusivo on tho
question, and judicial notico shall bo taken thereof.
