Abstract
This article studies the provisions of the Code of Judicial Conduct and the
Code of Ethics for Court Officials in the context of social media usage; the consequences of
amending the two previously mentioned Codes in order to encourage Judges and Officials to
use social media ethically; and how to encourage ethical social media use by employing
appropriate methods suitable for the Court of Justice culture. According to the study, parts
of the Codes already prohibit the dissemination of unlawful, immoral, or unethical content,
as well as information that violates the Code of Conduct or standard practice, but the
prohibitions of the Codes do not cover all types of dissemination of information that affects
a social media user's or the Court of Justice's image. Adding social media usage rules to the
Codes, on the other hand, is unlikely to be the best approach because it may reduce the
Codes' decisiveness and certainty, and it may result in excessive control if disciplinary
investigations are conducted into all cases of alleged judge in social media improper use.
Until now, the Judicial Commission and the Court Officials Commission have interpreted the
current provisions of the Codes in order for them to be appropriately implemented in a
changing society and to prevent situations of utilizing social media that may cause significant
damage to the Court of Justice's image without amending the Codes' provisions. According to
the study's findings, three approaches are appropriate for the Court of Justice's organizational
culture and the realities of social media usage: incorporate social media technologies and
usage norms into trainings for judges and officials; use communication channels to improve
such information and comprehension among them; and provide them the opportunity to
obtain such information and comprehension through the trainings of specialized organizations.
