AN ADMINISTRATIVE REGULATION PERTAINING TO
THE ACCRUAL, USE AND PAYMENT OF
COMPENSATORY TIME
FOR NON-EXEMPT EMPLOYEES
SECTION 1, Purpose
The purpose of this administrative regulation is to establish
guidelines governing the accrual , granting, use and payment of
compensatory time for non-exempt employees.
SECTION 2. Policy
It is the policy of the City of Farmington to adlllinister the
compensatory time progrBlll in accordance with the applicable
provisions of the Fair Labor Standards Act, ether applicable wage
and hour laws, and the city Personnel Rules.
SECTION J, Eligibility
A. All employees not designated as "exempt" by adlllinistrative
re9ulation are eligible to receive compensatory time off at
th~ rate of time-and-one-half in lieu of monetary overtime
compensation for any time 'llrorked in excess of the defined
workweek or other ap·plicable work period.
B. Any combination of compensatory time and overtime payment in
cash (e.q, one hour compensatory time credit plus one-haltr the
employee's adjusted regular rate of pay in cash for each hour
of overtime worked) may be received so long as the policy of
compensation at time-and-one-half is maintained.
c. Compensatory time may be earned in lieu of cash payment when:
(1) the employee has not accrued compensatory time in excess
of the limits established in this ~dministrative regulation
and (2) such compensation is in accordance with departmental
policy or procedure establis~ing an understanding as to the
method of compensation for overtime worked, so long as such
policies or procedures do not conflict with the guidelines set
forth in this administrative regulation.
D. In the absence of a.n established understanding regarding the
!arm or overtime compensation as set forth in Section 3 (C),
an agreement to accept compensatory time in lieu of monetary
payment must be arrived at between the employee and department
head or designee before. the performance of overtime work.
such agreement to accept compensatory time must be entered
into by the employee freely and without pressure or coercion.
A record of such agreement and compensation shall be kept by
