SECTION 4, scheduling the Use of compensatory Time
A. An employee who bas accrued compensatory tirne must request the
use of such time in advance. With departmental approval, the
employee shall be permitted to use such time off within a
reasonable period after making the request, if the use does
not unduly disrupt operations. Any compensatory time used by·
the employee will not be counted as hours worked in the
computation of overtime within the work week.
Approval shall be based on consideration of such factors as
the normal schedule of work, anticipated peak workloads,
emergency requireJ11ents for stat"f and services, and the
availability of qualified substitute staff when required.
Denials of requests must be based on the tact that the time

off would impose an unreasonable burden on the department s
ability to provide services of acceptable quality.
B. Management may direct an employee to use ace.rued compensatory
time in accordance with an established departmental policy or
procedure.
c. In the absence ot a memorandum of understanding or
departmental policy, management may assign compensatory time
off, with the affected employee's agreement , in order to
manage staffing requirements and fiscal res~raints.
SECTION 5. Limitations
A. No non-exempt employee (except Fire shift personnel) shall
accrue eompensato.ry time in excess of 90 hours { 60 hours of
overtime at time-and-one-half). Fire shift employees may not
accrue more than 126 hours (84 hours of overtime at time-and-
one-ha lf) • Al 1 overtime worked in excess of the maximum
accrual rate shall be compensated in cash payment of time-and-
one-half.
B. Upon termination, the employee shall be paid for unused
compensatory time at a rate equivalent to: (1) the average
regular rate received by such employee during the last three
years of his/her employment, or {2) the final regular rate
received by the employee, whichever is higher.
c. When taken, compensatory time shall not be considered as hours
worked for the purposes of computing overtime.
