Section 6. Removal Provision for Officers
A. A chapter officer who fails to fulfill the duties of office may be removed
from office upon the vote of two thirds (2/3) of the Membership. Removal
may be defined as unable to fulfill the duties of office, non responsive to
the Executive Committee, non responsive to the membership, mishandling
of Chapter funds or for cause as determined by the Executive Committee.
B. The Executive Committee shall promptly send notice by certified mail,
return receipt requested and by regular mail to the Chapter Officer identified
for removal, advising the Chapter Officer of impending removal. The
Chapter Officer shall have fifteen (15) calendar days to respond to the
Executive Committee in writing. If a majority of the Executive Committee
determines there is cause for removal, then the Executive Committee shall
notify and advise the Chapter Officer within fifteen (15) calendar days of
its recommendation for either removal or non removal of the Chapter
Officer. The Chapter Officer identified for removal by the Executive
Committee shall be referred to the Membership for a vote on the officer’s
removal or non removal from office at its next regular meeting.
C. The Chapter Officer identified for removal shall have thirty (30) days to
appeal after receiving notification of removal, first to the local chapter
Executive Committee and second to the Regional Director. If a majority of
the local Executive Committee grants the appeal, the Chapter Officer shall
be reinstated. If the Chapter Officer does not
receive a majority vote from the Executive Committee; they may appeal to
the Regional Director within a timeframe designated by the Executive
Board.
D. A Chapter Officer identified for removal shall be able to appeal first to the
Regional Director. If the matter cannot be resolved at the regional level, a
further appeal may be made to the National Executive Board.
1. Removal is final if the member fails to respond to the President’s
Letter of Non-Compliance in seven (7) days. Removal is final if the
member fails to comply with the Appeal procedures as specified in
the Bylaws.
Section 7. Vacant Positions
A. A vacant position will be evaluated by the Executive Committee and a
recommendation will be given to the membership body to fill or leave the position
vacant to be approved with a 2/3 vote of the members in good standing present and
eligible to vote.
