P. 27

Exempt employees are paid on a salary basis and are not eligible for overtime pay. Exempt employees are expected
to work as many hours as required to perform the duties of their position.

Nonexempt employees must always report all hours worked. Working “off the clock” is not permitted and no
manager may ever direct a non-exempt employee to do so. If a non-exempt employee believes he or she has been
directed to refrain from recording time worked, the employee must contact Human Resources immediately.

               4.1.2 Breaks
E3 does not generally schedule rest periods or breaks, other than meal breaks during the workday, unless applicable
law requires otherwise. However, if a client does schedule such rest periods or breaks, they will be usually be for 15
minutes. For lunch or meals, employee meals will depend on the client policy; this may vary between 30 minutes to
1 hour of non-working time. Non-working time taken for lunch cannot be charged to E3 or the client and is unpaid.

               4.1.3 Lactation Breaks

E3 will provide reasonable breaks for an employee to express breast milk for her nursing child for one year after the
child’s birth in accordance with the provisions of the Patient Protection and Affordable Care Act (or longer if applicable
state/local law requires). The Act requires employers to provide a location (other than a bathroom) shielded from
view and free from intrusion from coworkers which may be used by employees to express breast milk. E3 will provide
qualifying employees with the use of a room or other location to express milk in private. If you intend to make use
of such break time and believe no room is currently available for you, please contact Human Resources as soon as
possible so that E3 can arrange for such a room for you. Lactation breaks may be taken every time an employee has
reasonable need to express breast milk and may be taken concurrently with normally scheduled break periods. Non-
exempt employees should clock out for any time taken that does not run concurrently with normally scheduled break
periods, and such time will be unpaid.

4.1.4 Telework and Alternate Work Schedule (AWS)
You may request the opportunity to vary your work schedule and/or location (within client and E3-defined limits) to
better accommodate personal responsibilities. Subject to your work assignments and E3 Human Resources approval,
your E3 Manager shall determine the location and hours of employment that best suits the needs of the work to be
done. Please reference the E3 Telecommuting SOP located on the Internal SharePoint Portal for more details.

immediately before. If a payday falls on a holiday you will be paid the prior workday.

               4.3 Attendance and Punctuality
E3 is able to secure work based upon our estimates of performance and our history of reliability. Therefore, E3
expects you to assume diligent responsibility for your regular and reliable attendance and promptness. Continued
dependability, quality, and pride of service are factors over which each individual employee has a great deal of
influence. If you are absent unexpectedly without reason and cannot perform your duties on time, or if you produce
substandard work, we all pay the price by losing the confidence of the customer.

It is extremely important that you be punctual in your arrival for work at the beginning of the workday or shift to
which you are assigned. If you know that you will be absent or late arriving for work, notify your E3 Manager as soon
as possible but within the first 30 minutes of your work shift each day of your absence, unless you are granted a
leave of absence. In the event of a sickness or accident while performing your duties or if you otherwise need to
leave before the end of your normal workday, notify your E3 Manager immediately.
