Salah satu penentang unifikasi hukum tersebut
adalah M.M. Djojodigoeno, didikan Rechtsschool dan
Rechtshogeschool serta berpengalaman lama sebagai
Hakim Ketua Landraad pada masa Kolonial Belanda.
Djojodigoeno mengatakan: “You cannot alter social
conditions by making laws ... Law has to adjust itself to social
condition. You cannot unify law where social conditions do
the converse”

Dalam perdebatan tersebut, Pemerintah Indonesia
lebih mengedepankan legal centralism dan unifikasi,
baik atas teritori, sistem hukum dan administrasi. John F.
McCarthy mengatakan:
After Indonesian independence, the national
government faced the challenge of creating of unified
and uncontested adminstrative authority, and State
policy towards adat now involved the establishing of
the primacy of State system over other institutional
arrangements. Consequently, despite adherence
to the notion of adat in nationalist discource, the
Indonesian Republic attempted to set up a unitary
administrative system accross the archipelago,
