ù... The Code Napoleon was far superior to its predecessors as to style, legislative
technique, and the spirit that pervades it. The style of the Code is a literary as well
as a legal masterpiece; its language is clear and precise, concise and direct.
Likewise, legislative technique followed by its drafters, although by no means
immune from defects, still commands considerable respect. The provisions of the
Code are neither vague nor subtle; they proceed from reality to reality, and not from
reality to abstraction; qualifications, limitations and exceptions are kept down to
a bare minimum, confusing casuistry and sterile abstractions are entirely absent.
Moreover, the drafters of the Code Napoleon were able to express legal concepts,
and to formulate legal provisions in the language currently employed by the French
people in its everyday life and therefore generally understood; literal interpretation
